Washington, DC Robbery Attorney

In Washington, DC, robbery is defined as the taking of anything of value from another by force or violence, and whether against resistance or by sudden or stealthy seizure or snatching, or by putting the person in fear.  A robbery conviction carries a prison sentence of between two and fifteen years.  A defendant convicted of attempted robbery may face up to three years in prison.

Use or availability of a firearm, or dangerous or deadly weapon during the robbery, including a sawed-off shotgun, shotgun, machine gun, rifle, dirk, bowie knife, butcher knife, switchblade knife, razor, blackjack, billy, or metallic false knuckles, increases the potential criminal penalties. There is a mandatory five-year prison term for armed robbery committed with an operable firearm.

Carjacking is a related crime, and is defined as taking immediate and actual possession of another’s vehicle knowingly or recklessly by force or violence, and whether against resistance or by sudden or stealthy seizure or snatching, or by putting the person in fear.  Carjacking carries a mandatory minimum of seven years’ incarceration, and a maximum of twenty-one years. 

A defendant can be charged with armed carjacking if the use of a firearm or dangerous or deadly weapon, including a sawed-off shotgun, shotgun, machine gun, rifle, dirk, bowie knife, butcher knife, switchblade knife, razor, blackjack, billy, or metallic false knuckles, is used during the carjacking or attempted carjacking.  Armed carjacking carries a mandatory minimum penalty of fifteen years in prison and a maximum of forty years.  A person convicted of either carjacking or armed carjacking is not eligible for release before serving the mandatory minimum sentence.
